These Terms of Service ("Terms") govern your use of the ATcarely mobile application (the "App") and related services offered by ATcarely ("ATcarely," "we," "us," or "our") through https://atcarely.com.
By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. About ATcarely
ATcarely is a family care coordination app. Caregivers can create reminders and tasks for loved ones. Care recipients can join with a family code to view tasks, receive local reminders, mark tasks complete, and optionally submit photo proof.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.
3. Accounts and Access
3.1 Caregiver accounts
Caregivers sign in using Google authentication. You are responsible for maintaining the security of your Google account and for all activity that occurs through your caregiver account.
3.2 Family code access
Care recipients join using a family code provided by a caregiver. Anyone with the family code may access that family's shared task list. You are responsible for keeping the family code confidential and sharing it only with intended family members.
3.3 Accurate information
You agree to provide accurate information when using the App and to use the App only for lawful family care coordination purposes.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful, harmful, or fraudulent purpose;
- Harass, abuse, or harm another person through the App;
- Upload content that is illegal, offensive, infringing, or violates another person's rights;
- Attempt to access another family's data without authorization;
- Reverse engineer, scrape, overload, or interfere with the App or its systems;
- Use the App to provide medical, emergency, or professional healthcare services.
5. Not Medical or Emergency Services
ATcarely is a reminder and coordination tool only. It is not a medical device, healthcare service, emergency response service, or substitute for professional care, supervision, or emergency assistance. Do not rely on the App as your only method of ensuring someone's safety or health. In an emergency, contact local emergency services immediately.
6. Reminders and Notifications
The App may schedule local notifications on a care recipient's device for pending tasks. Delivery of notifications depends on device settings, operating system behavior, battery optimization, network conditions, and whether the App has been opened recently enough to schedule reminders. We do not guarantee that notifications will always be delivered on time or at all.
7. Photo Proof
7.1 How it works
When photo proof is enabled, care recipients may submit photos showing task completion. You grant us permission to store, process, and display such photos to authorized members of the same family group for verification purposes. Completed tasks and associated photos may be automatically deleted after 30 days, as described in our Privacy Policy.
7.2 User Content and Reporting
You are responsible for photos and task text you upload. You agree not to upload content that is illegal, pornographic, violent, harassing, hateful, or infringes others' rights. ATcarely does not allow objectionable content. If you find content that violates these Terms, you can delete it from your family group or contact us at hello@aungheinhtet.com to request removal. We reserve the right to remove any content and suspend accounts that violate these Terms.
8. Fees and Promotions
ATcarely may be offered free of charge during promotional periods. We may introduce paid features or subscriptions in the future. If we do, we will provide notice within the App or on our website before charging you.
9. Intellectual Property
The App, including its design, software, branding, and content provided by ATcarely, is owned by ATcarely or its licensors and is protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of content you submit, such as task titles and photo proof, but you grant us a license to host, store, display, and process that content solely to operate the App.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
11. Third-Party Services
The App relies on third-party services such as Google sign-in, Supabase, and Expo. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services outside our control.
12. Suspension, Termination and Data Deletion
You may stop using the App at any time by logging out, leaving a family group, or uninstalling the App. We may suspend or terminate access to the App if we reasonably believe you violated these Terms, created risk or legal exposure, or if we discontinue the service.
You may request deletion of your account and family data at any time by using Leave Family in the app or by emailing us at hello@aungheinhtet.com with your family code. We will delete your data within 30 days as described in our Privacy Policy, unless we must retain it for legal reasons.
The App is not directed to children under 13. If we learn we have collected personal information from a child under 13, we will delete it promptly.
13. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM LOSS OF DATA.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATCARELY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
15. Indemnification
You agree to defend, indemnify, and hold harmless ATcarely from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App, your content, your violation of these Terms, or your violation of any rights of another person.
16. Changes to the App or Terms
We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. When we do, we will revise the "Effective date" above. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply in your country of residence.
